Terms & Conditions
Last updated: August 2026
These Terms & Conditions ("Terms") govern the services provided by Orkestrium("we", "us"), a business registered in France (full entity details in our Legal Notice), to you ("the Client"). By engaging our services or purchasing through our website, you agree to these Terms.
1. Services
Orkestriumprovides project-automation services for HVAC and MEP projects — including milestone and KPI monitoring, automated alerts and escalation, and reporting — delivered as a configuration and pilot engagement on top of the Client's existing tools (e.g. Google Sheets, email). The precise scope is agreed during discovery and confirmed in writing before work begins.
2. Engagement & delivery
A typical engagement consists of a discovery call, a setup & validation phase (approximately 1–2 days), and a fixed-scope pilot (approximately 4–8 weeks). "Delivery" means we have configured and made available the agreed automation for the Client's project. Timelines are estimates and depend on the Client providing data, access and feedback in good time.
3. Payment
Fees and payment terms are as quoted for the engagement. Payments are processed securely by Stripe; by paying you also accept Stripe's terms. Unless otherwise agreed in writing, fees are due before the relevant phase begins. All fees are exclusive of any applicable taxes unless stated otherwise.
4. Refunds
Our refund terms are set out in our Refund Policy, which forms part of these Terms.
5. Client responsibilities
- Provide accurate project data and timely access to required systems.
- Nominate the contacts who should receive alerts and reports.
- Ensure you are entitled to share any third-party or personal data you provide for processing.
6. Limitation of liability
Our services are provided on a best-effort basis. While the system is designed to surface risks earlier, we do not guarantee any specific outcome, that every delay will be detected, or uninterrupted or error-free operation — including where third-party services (e.g. email, hosting or AI providers) fail or change.
To the fullest extent permitted by law, our total liability arising out of or in connection with an engagement shall not exceed the fees paid by the Client for that engagement. We are not liable for indirect or consequential losses, including loss of profit, contracts or data.
7. Confidentiality
Each party shall keep the other's non-public information confidential and use it only to perform the engagement.
8. Intellectual property
We retain ownership of our underlying methods, templates and reusable components. The Client owns its own data and the specific configuration deliverables produced for its project, subject to payment in full.
9. Governing law & jurisdiction
These Terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of France.
